5. Cancellation and Refund Policy
Cancellation terms may vary depending on the type of service, timing of cancellation, and whether third-party costs have already been incurred. Unless a more specific written policy applies, the following conditions apply:
- Cancellations made well in advance of the booking may be eligible for a partial refund, less any non-refundable deposits, administration fees, or committed third-party costs.
- Short-notice cancellations may be subject to a cancellation charge, which may be up to the full booking fee where we are unable to rebook the slot or recover our costs.
- No refund will be due for services already provided, equipment already supplied, or post-production work already undertaken.
- If you fail to attend, arrive late, or are unable to proceed due to incomplete preparation on your side, the booking may be treated as cancelled or may continue to be charged in full.
- Where we must cancel or reschedule due to operational, safety, technical, or force majeure reasons, we may offer a rebooking, credit, or refund at our discretion, subject to applicable law.
Any refund due will be processed using the original payment method where reasonably possible and within a reasonable time after approval.
6. Liability Limitations
To the fullest extent permitted by applicable law, LumenFrame Studio Ltd shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary losses, including loss of profit, revenue, business opportunity, goodwill, or anticipated savings.
- Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
- Our total aggregate liability arising out of or in connection with any service shall be limited to the amount paid by you for the relevant service giving rise to the claim, except where a higher limit is required by law.
- We are not responsible for delays or failures caused by your acts or omissions, third-party service providers, internet or platform outages, equipment supplied by you, or events beyond our reasonable control.
- You are solely responsible for backing up your own files, footage, recordings, and materials unless we expressly agree in writing to store or manage them.
You acknowledge that studio and production activities carry inherent risks, including technical failure, equipment malfunction, and data loss, and you accept those risks to the extent permitted by law.
7. Intellectual Property Rights
All intellectual property rights in our studio branding, templates, workflows, methods, systems, equipment configurations, designs, and pre-existing materials remain the property of LumenFrame Studio Ltd or our licensors.
- You retain ownership of content, footage, images, scripts, and other materials that you create or supply, subject to any third-party rights.
- By supplying materials to us, you grant us a limited, non-exclusive, royalty-free licence to use those materials solely to provide the services and fulfil our obligations under these Terms.
- Unless otherwise agreed in writing, any editing assistance, production support, or technical setup does not transfer ownership of our underlying tools, templates, or processes to you.
- You are responsible for ensuring that your use of any output produced through our services does not infringe the rights of others.
If we create commissioned deliverables for you and the ownership or licensing terms are not separately agreed in writing, all rights in our pre-existing materials remain reserved, and you receive only the rights necessary to use the deliverables for the purpose agreed in the booking or invoice.
